Criminal Defense

Peter T. Kelley has successfully represented clients on offenses ranging from Disturbing the Peace to Armed Robbery.

  • OUI Operating Under the Influence (OUI) in Massachusetts is a very serious offense. "Melanie's Law" was signed in October 2005. As a result, there was a significant increase in the penalties for OUI. There are lifetime look backs for previous offenses. You may have taken a plea in the 1980s thinking it was getting dismissed. However, now you face a second offense.

You should contact an attorney immediately if you are arrested or receive a summons to appear in the mail. With the right argument, cases can be dismissed at clerks hearings. Motions can be filed at arraignment to preserve evidence that may otherwise be destroyed. You need to act immediately to protect your rights.

Family Law

Attorney Kelley regularly appears in the Middlesex and Essex Probate and Family Courts. Attorney Kelley is a qualified for Limited Assistance Representation (LAR). This allows him to represent or assist litigants with part but not all of his or her legal matter. He can provide legal advice on drafting your pro se documents or represent you all the way to trial.

  • Divorce

You can initiate an action for divorce or for separate support by filing a complaint in the Probate and Family Court. You do not have to be living apart from your spouse in order to file for divorce.

Attorney Kelley can explain your legal rights if you are looking to file or have been served with divorce papers. We regularly file temporary order motions asking for temporary custody, temporary support, temporary visitation, orders to vacate the marital home and others. 

There are several grounds for divorce in Massachusetts. However, many come to an agreement before trial and are then filed as a Joint Petition under G.L. c.208, sec 1A.

  • Spousal/Child Support

Massachusetts recently passed the Alimony Reform Act of 2011, which went into effect on March 1, 2012. This new law provides limits on the length, amount, and co-habitation rules in relation to alimony. The act groups all alimony into specific categories: General Alimony, Rehabilitative Alimony, Reimbursement Alimony, and Transitional Alimony. Click here to view the act.

  • Restraining Orders/Harassment Orders

Restraining orders can be sought in either the Probate and Family Court or the District Court.

Personal Injury

What should you do after the accident?

Get medical attention as soon as possible. Follow your doctors recommendations for treatment and keep your appointments.

Get as much information as you can about the accident. Write down any witnesses names and contact information. Take pictures of the scene, the damaged vehicles, and your injuries.

It is very important to get medical care immediately after your accident for proper diagnosis. It is also important to keep your medical appointments and follow through with the course of treatment. This will not only help you physically recover from the accident but also strengthen your personal injury case.
